Lawyer in Custody Battle Wants DNA Sample from Anna Nicole Smith's PartnerLOS ANGELES -- Anna Nicole Smith has been laid to rest, at least for now -- but the battle continues for custody of her baby girl.The attorney for one of the men claiming to be the father -- Larry Birkhead -- today asked a judge in Los Angeles to order another of the men, Howard K. Stern, to come to California and provide a DNA sample. Stern and the baby, Dannielynn, are currently living in the Bahamas. Stern's attorney argued against the request, pointing out that Stern is already listed as the father on the baby's birth certificate. Judge Robert Schnider is expected to rule on Birkhead's request in two weeks.
